I don't think people should condemn this vessel with out all the facts about the incident in question that we just happened to witness. First of all they vessel and family are truly some of the good people out there and always try and assist in helping us get bait.

The seiner had made a 50 ton set one mile above the reserve he worked and hatched the set all out side of the reserve. In the set he had a small mixture of sardines that where just the right size that they gilled in the net.

This seiner docks and unloads in Ventura and the harbor prohibits a vessel with a net that dirty to enter the harbor for obvious reasons so they have to clean the net outside the harbor. He dumped his net above and outside the reserve to clean it not fishing it clean it they never pursed the net. As they where doing this they drifted down toward the reserve and the coastguard helicopter flew over and claimed he drifted into the reserve by 100 yards. I don't think he was in the reserve and neither does he.

If he is guilty of anything he is guilty of having gear in the water in the reserve but not taking in the reserve. This is a classic case of our enforcement agency being overzealous and a little to aggressive before they have all the facts. And then to make things worse the media runs with it. I just felt that these eyewitness accounts should be known before people give an opinion.

Joe

Joe, i think the news was pretty quick to jump to conclusions. They should say "alledgedly" fishing
im sure DFG just wants to give themselves a big pat on the back

i was thinkin maybe they were just traveling through the closure headed home or something and dfg thought they were fishing

You know that they can be so aggressive and the way they treat us sometime. It is as if you are the enemy I am sure you have been through it.

Well am I the only one that thinks it is stupid to protect bait in these areas? Am I missing something some how? I realize that "other" fish could get caught in the nets but seems just a little over the top to begin with.

Joe thanks for giving us the info. I hope all works out in the end that they don't get to reamed.
